Key terms
Dropping Charges - Once a New York prosecutor has issued charges for domestic violence for allegedly assaulting the victim, the alleged victim no longer has authority to have these charged dropped. While the victim is the individual wronged, crimes in New York are offenses against the state and violate state law, not individual rights. I can help you navigate how it may be possible to get these charges dropped.
Orders of Protection - A temporary order of protection is a court order requiring a defendant in a criminal case to stay away from the alleged crime victim. The Order of Protection is an order of the court. Even if the issues between the parties are resolved, the Order of Protection is in effect until it is changed or dismissed by the court. This can means that if you are arrested for domestic violence you can be forced to leave your home if there is a full Order of Protection is issued.
Full Orders of Protection – To stay away from protected person and children and anywhere they frequent like work or school and to surrender firearms.
Limited Orders of Protection - the parties can have contact but must refrain from committing criminal offenses against the protected party (like harassing, assault, stalking, etc.)
